R. Eugene (Gene) Varndell, Jr., a partner with Posz Law Group, has extensive experience in a variety of IP areas. He has worked with corporate engineers in writing numerous patent applications. He has represented clients on intellectual property prosecution and opinions, particularly patent and trademark prosecution and patent infringement, validity, enforceability, and due diligence opinions.

Mr. Varndell has amassed a wealth of experience in patent and trademark prosecution and patent opinion work. Mr. Varndell has authored legal opinions on patent matters that were validated at the U.S. International Trade Commission and in U.S. District Courts. Mr. Varndell has lectured throughout the world, especially in Japan, to professional and bar audiences on many issues of patent prosecution and litigation.

Prior to entering private practice, Mr. Varndell served for six years as a patent examiner in the U.S. Patent and Trademark Office. Prior to joining Posz Law Group, he founded and operated Varndell & Varndell, PLLC for 19 years, a private law firm specializing in the practice of intellectual property law. Before founding Varndell & Varndell, PLLC, he was a partner at the IP law firm of Armstrong, Nikaido, Marmelstein & Kubovcik.

Mr. Varndell has handled cases covering a diverse spectrum of mechanical, chemical, and electrical technologies, with emphasis on cases involving construction machinery and software, computer products, biotechnology, and pharmaceutical and all types of chemistry.

Litigation
Lead patent attorney for plaintiff in S.R.M. Company, Inc., et al. v. Diversified Specialist Inc., Civil Action No. 91-6720, U.S. District Court for the Eastern District of Pennsylvania.

Lead trademark attorney for defendant in Phoenix Closures Inc. v. Yen Shaing Corp. Ltd. (TTAB), Opposition No. 76,316, 1988, 2 USPQ2d 1891.
